Wills, Estate Planning and Health Directives

Writing a will, establishing a trust, planning for significant health challenges, and making plans for probate proceedings are not things anyone likes to dwell on, but a little planning now can make a big difference for your heirs and loved ones later on. Tornatore Law is here to be your partner–to help you clarify your goals, to identify and plan for the assets you have now, and to re-assess your plans regularly in the years to come. We want you to be able to rest assured that your estate will be handled in accordance with your wishes, and with the utmost care.

The Process

1. Initial Consultation

In an initial consultation, we want to ensure that we come to understand your values, goals, and concerns related to planning for significant health challenges, end-of-life care, and the settling of your estate. This conversation sets important guide posts for the rest of our planning process.

2. Personal Questionnaire

After our initial consultation, we will ask you to fill out a questionnaire that helps us capture all of the specific information we will need to draft your documents. This may include things like the names and addresses of your heirs, the specific assets that need to be considered (real estate, bank accounts, life insurance policies, retirement accounts, etc.), and who should serve in key positions (health care proxy, executor of your estate, etc.). It’s okay if you don’t have all of the answers right away; the questionnaire is there to help guide our ongoing conversation about your wishes, and drill down to the specifics so that we address all of your needs.

3. Draft, Review, and Finalize Documents

Once we have the necessary information, we will draft documents to reflect your decisions, which we will send to you to review at your convenience. We will stand by to answer any questions you may have, and talk through any changes that you may wish to make, until you are 100% comfortable and confident to sign the final documents. We will ensure that you have final copies of your documents, and that we retain copies in our files, and if necessary we will file documents with government offices.

4. Future Consultations

Signing your documents is not the end of the road! People often tuck their estate plans in the back of a file cabinet and in the back of their mind, not realizing that as your life continues to evolve, your estate plans must evolve, too. If there is a significant change in your assets, your heirs, or your wishes, we are here to talk through what those changes mean for your estate plans, and to update or replace documents as-necessary.
