Real Estate Transactions

Whether you’re buying your new home or investing in residential or commercial property, Tornatore Law is here to protect your interests at every step. We’re not just there at the closing table, we’re with you for the entire process: coordinating with your real estate agent, your lender, government offices, and the other party’s team from start to finish.

The Process

1. You Found the Right Deal for You
Whether a Buyer or Seller, most often our clients get in touch with us once an offer has officially been made and accepted for the property, so that we can start working on the specifics of the transaction. But we are also happy to engage even earlier, if you would like to have a consultation before you start your search, put your property on the market, settle on a lender, or make or accept an offer.
2. Initial Consultation and Engagement
To start, we want to have a phone call to learn a few things: What are your goals for this transaction? Have any specific issues already been discussed between you and the other party? Is there anything you’re unsure or uneasy about? We will also discuss our fees. If you decide to become a client of Tornatore Law, we will ask you to sign an Engagement Letter that lays out our responsibilities to each other (including all fees).
3. Contract Negotiations
Some clients come to use with a contract-for-sale already signed, and some don’t. If you have not already signed a contract, we will work with you and your realtor, and the other party’s team, to negotiate and sign a contract that protects your interests. Often the contracting stage is rushed through, when everyone is excited about making the deal happen, but this is a crucial stage where Tornatore Law can do a lot to protect you—from making sure everyone has agreed to realistic deadlines, to ensuring all of the required disclosures are made and safety and environmental regulations are considered, and including contingencies that protect your investment and rights in case something unexpected happens in the course of the deal.
4. Inspections
We all hope that inpsections go perfectly, and no new issues are discovered; in today’s competitive real estate market, there’s even a strong temptation for Buyers to waive inpsections to make their offer more appealing. But the reality is that inspections often do reveal issues, and Tornatore Law is here to work with everyone toward a resolution. Often a smaller issue can be resolved by negotiating to have the problem fixed before closing, or adjusting the cost of the transaction—Tornatore Law strives to collaborate with everyone involved and protect your interests while getting the deal done. Inspections may uncover bigger problems that are deal-ending—that’s when Tornatore Law will do everything possible to minimize your losses and put you back in a position to go find your next opportunity.
5. Coordination with Other Parties
In a property transaction, there are a lot of people involved, and a lot of details to handle, even when everything goes exactly right. Realtors, brokers, lenders, title policy providers, insurance companies, inspectors, permit offices, town clerks, the other party’s attorney, and more. It’s a lot to juggle, and it’s easy to drop a ball. Tornatore Law has the expertise and experience you need to keep everything on track and moving forward.
6. At the Closing Table
When it’s time to finalize the deal, you can rest assured that Tornatore Law is there to work through any issues that may pop up at the last moment, and take you step-by-step through the documents to answer all of your questions. We strive to ensure you feel comfortable and secure when you sign on the dotted line.
